Terms and Conditions of Sale
1. General
These Terms and Conditions of Sale ("Terms") govern the provision of language immersion teaching services in France ("Services") by Gwenaël SIMON ("Teacher") sole proprietorship of Chez Miss Gwen (French registration : SIRET number 98424389900015) to the client ("Client"). By engaging the Services, the Client agrees to these Terms.
2. Services
2.1 The Teacher agrees to provide a French comprehensive language immersion experience, including:
- Three French workshops
- Accommodation for six nights in an ensuite double bedroom at 178, route de Nîmes 30350 Montagnac (France)
- Nine to ten meals at the Teacher's home.
- Transport in a private car for local travel.
- Four excursions with the Teacher as guide.
- A total of 35 hours of French practice is guaranteed.
2.2 The Services do not include:
- Restaurant bills and private beverages or snacks.
- Entrance fees for excursions.
2.3 The services include a tailored schedule for the stay agreed between the Client and the teacher
2.4 The client is responsible for their own travel expenses to and from the immersion location
3. Fees and Payment
3.1 The total fee for the Services is 1800 EUR. This fee covers accommodation, specified meals, and local transport.
3.2 A deposit of 30% of the total fee must be paid at the time of booking to secure the reservation. This deposit is non-refundable.
3.3 The remaining fees must be paid no later than 30 days before the arrival date.
3.4 Accepted payment methods include bank transfer, PayPal, or other methods as agreed.
4. Cancellation and Rescheduling
4.1 If the Client needs to cancel or reschedule the immersion experience, they must provide at least 30 days' notice. Failure to do so will result in forfeiture of the deposit.
4.2 Cancellations made within 30 days of the arrival date will result in a charge of 70% of the total fee.
4.3 The Teacher reserves the right to cancel or reschedule the immersion experience. In such cases, the Teacher will provide as much notice as possible and will arrange a new date for the immersion experience or offer a full refund.
4.4 If the cancellation is due to a force majeure event on the teacher part (an unforeseeable and insurmountable event, such as a documented illness), 70% of the price will be refunded.
4.5 The weather cannot be considered a reason to cancel the stay.
5. Refunds
5.1 Refunds will only be provided in exceptional circumstances and at the discretion of the Teacher.
5.2 If the Teacher is unable to provide the agreed Services due to unforeseen circumstances (such as illnesses, physical injuries or a close friend or family member's passing) a prorated refund will be offered for the missed days.
6. Responsibilities of the Client
6.1 The Client agrees to participate actively and engage in the learning process.
6.2 The Client must respect the accommodation and facilities provided, ensuring they are kept in good condition.
6.3 The client will be responsible for reimbursement in case of breakage or damage.
7. Confidentiality
7.1 Both parties agree to keep confidential any information shared during the provision of the Services.
7.2 The Teacher may use anonymized data for professional development purposes, provided no personal information is disclosed.
8. Liability
8.1 The Teacher is not liable for any loss or damage resulting from the use of the Services, except in cases of gross negligence or willful misconduct.
8.2 The Client acknowledges that results from language learning can vary and depend on the Client's effort and commitment.
9. Termination
9.1 Either party may terminate the agreement for Services by providing 30 days' written notice.
9.2 In the event of termination by the Client, any fees for Services already rendered are non-refundable.
10. Governing Law
10.1 These Terms are governed by and construed in accordance with the laws of France.
10.2 Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Nîmes, France.
11. Amendments
11.1 The Teacher reserves the right to amend these Terms at any time. The Client will be notified of any changes in writing.
11.2 Continued use of the Services after amendments have been made constitutes acceptance of the new Terms.
12. Additional Costs
12.1 The Client is responsible for all restaurant bills and entrance fees for excursions.
12.2 Any additional costs incurred during the immersion experience must be settled by the Client promptly.
Annex: Tailored Schedule
The tailored schedule for the immersion experience will be developed in collaboration between the Client and the Teacher and will be provided as an annex to these Terms.
